The Four Labour Codes, although having received the assent of the President of India in 2020, have been notified and brought into force from 21st November 2025. The Codes have replaced 29 labour statutes which is indeed a major overhaul. The Codes provide stringent penalties for any non- compliance. The Supreme Court of India has held that all applicable Labour Statutes form implied conditions of service in every contract of employment and would thus apply even if not expressly stated.
The Government of India has announced that the Labour Codes would simplify and streamline labour laws and provide better wages, safety, social security and enhanced welfare for the Indian workforce. On the other hand, Trade Unions have been opposing the implementation of the Labour Codes, and in particular, the Industrial Relations Code.
The Rules/Regulations/Schemes have not been notified as yet and is expected to take some time considering the fact that the draft Rules/Regulations/Schemes have to be first notified for public opinion. Pending final notification of the Rules would the Labour Codes be implementable?
