The Municipal Commissioner of Municipal Corporation of Greater Mumbai, has, in exercise of the powers conferred upon him by the Government of Maharashtra under Sections 2, 3 & 4 of the Epidemic Diseases Act, 1897, read with the Regulations dated 13th March, 2020, has issued directions to implement certain containment/prevention measures of COVID-19 in the City of Mumbai.

The Order No.MGC/A/2915 dated 20th March, 2020, inter-alia, state that all private corporates and establishments to be completely shutdown. However, certain establishments providing essential services, as enumerated in clause 3 of the aforesaid Orders, are excluded from the shutdown.

Industries engaged in production/manufacturing processes which require continuity of process are allowed to function at 50% staff strength. If there is a doubt as to whether a service or establishment is essential or not, the Municipal Commissioner would give a final decision on the same.

Failure to obey the aforesaid Orders issued by the Municipal Commissioner would attract penalty under Section 188 of the Indian Penal Code.

Member Companies are advised to take appropriate steps and ensure compliance with the aforesaid Orders issued by the Municipal Commissioner.

P.S:
The Municipal Commissioner has ordered a shutdown of establishments for prevention and containment of COVID-19, which cannot be construed as a closure of business for establishments not falling under clause 3. Thus, wherever possible Private Corporates and Establishments, which do not provide essential services, can instruct their staff to work from home during the shutdown period.
