Workshop on POSH - Gender Sensitisation - Feb 18, 2020

The Bombay Chamber of Commerce and Industry is pleased to announce a Workshop on “POSH - Gender Sensitisation” and Awareness of Prevention of Sexual Harassment Act 2013.  In today’s times of growing complexity we all need to reach out to others in their times of distress. There are various difficulties faced and need to make a difference is necessary. Gender sensitization could be a foundation to prevent sexual harassment at work place. 

 

The one day workshop is to understand the concept & insight of the law relating to Prevention of Sexual Harassment of woman at work place. The workshop will be suitable for both genders. The workshop will create a safe and healthy environment for women in the organisation resulting into better output.

 

Women are entering the work force in increasing numbers. Women’s rights have to be respected and protected. Women’s rights in a workplace are important so that they are free from unwanted sexual advances. Sexual Harassment at the workplace (SHW) lowers their productivity and psychological well being. 


Now the need is to prevent such incidents therefore we have a POSH Act that is the Prevention of Sexual Harassment Act. In 2013, many years after formulating the Vishaka guidelines, the Supreme Court passed the Prevention of Sexual Harassment or the POSH Act.

 

POSH Act enforces any organization to formulate a policy for the prevention of sexual harassment and redressal of the same. It mandates an internal complaints committee to address the issues and resolve them. This Act would also help to create awareness to sensitize about SHW. This can empower women to voice out against sexual harassment if there a need.

 

Awareness of Sexual Harassment at Workplace and Gender Sensitivity has to be a part of the work culture. This initiative would be a proactive step reflecting the ethos of a caring & progressive company besides being a mandate. Awareness and Reporting of Sexual Harassment at Workplace (SHW), both are low in most companies. People are not clear about - what is SHW, what recourse the victim can avail of, what steps the SHW committee can take to prevent or address SHW issues.  The best possible way is to prevent SHW could be through awareness and sensitization training programmes.

Objectives :

1.  To help prevent any SHW incident as a proactive measure by strengthening gender sensitivity  

2.  To create awareness about different dimensions of SHW

3.  To empower women employees  to protect themselves from SHW when required

1.  Sensitizing about gender inequality

2.  POSH Policy – objectives, scope, Supreme Court’s definition; types of SHW; conduct of sexual nature – physical, verbal & nonverbal harassment; gender discrimination at workplace  amounts to SHW

3.  Reasons for low reporting of SHW 

4.  Role functions and powers of SHW Committee & Sub Committee 

5.  Procedure to file complaints and Steps SHW victim should take 

6.  How to conduct a formal enquiry; investigation process – interview both parties, and resolve the SHW claim, strategies when there are No eyewitness  

7.  Consequences of policy violation  to victim and to the harasser

8.  Malicious Complaint  - to ensure no misuse of policy by women

9.  SHW offence under – a) Constitutional Law b) Civil Law c) Criminal Law & d) Service & Labour Law

10. Understand the Vishakha judgement clauses

Methodology :

Active and lively training methods like, Case Study, Discussion, will be used.

Dr. Lata Shetty is the Director, Mainstream Training Centre, which offers Soft Skills Training Programmes in a variety of settings.
