Awareness Seminar Mediation : A Cost-Effective Tool for Resolution of Disputes for SMEs - Jun 14, 2019

SMEs in India are vulnerable in pursuing litigation arising out of commercial disputes, because of their limited financial strength. Mediation offers them a level playing field. Some of the recent developments and provisions aim at quicker dispute resolution for SMEs. Section 12A of The Commercial Courts (Pre Institution Mediation and Settlement) Ordinance 2018, prescribes mandatory Mediation before a party can approach a commercial court with a Suit. Section 18 of the MSME Act of 2006 prescribes that any party to a dispute should make a reference to the Micro and Small Enterprises Facilitation Council which shall either itself conduct conciliation in the matter or seek the assistance of any institution or centre providing alternate dispute resolution services by referring the dispute to such an institution or centre, for conducting conciliation.


In this context, Centre for Mediation and Conciliation (CMC), established by Bombay Chamber and recognised by Hon’ble Bombay High Court as a `Mediation Institution’ as per Commercial Courts Act 2015; jointly with Ministry of MSME, Government of India is organising an awareness seminar.

Objectives of the seminar :

1.      To create awareness about Mediation in the context of Commercial Disputes

2.      To familiarise the SMEs and other stakeholders with recent amendments and procedures

3.      To address concerns and issues of SMEs in initiating Mediation/Conciliation process

4.      To share success stories and lessons from failures in Alternate Dispute Resolution
