Interactive Session on Prevention of Corruption (Amendment) Act 2018 - Sep 21, 2018

Background :

We would like to bring it to your notice that in consonance with India’s obligation under the UNCAC -( United Nations Convention against Corruption) the Government of India has now enacted  The Prevention of Corruption (Amendment) Act -2018.

Certain far reaching changes have been made to the new Act . Bribe giving is made a cognizable offence. 

A commercial organisation will now be liable, if any person associated with it gives or promises to give any undue advantage or reward to a Public Servant. If proved that the offence is committed by the commercial organisation with the consent or connivance of any Director, Secretary, Manager or any other officer, such persons shall be punishable with imprisonment & fine. 

In all such Criminal cases under CrPC , the enforcement agencies in India always implicate the Directors particularly the Managing Director to show their power & impact . 

While the intentions of the act may sound  very altruistic, the fact & reality of Corruption in India is far more severe & its “practitioners “have converted it into an “Art “ , most professionals will be loathe to acquire.

This Session specifically seeks to address concerns to ameliorate the understanding of the Prevention of Corruption (Amendment) Act 2018, particularly the provisions relating to the private sector. The session will also discuss and deliberate upon the measures and systems that can be put in place by organizations to mitigate the risk of damage to their reputation and safeguard their directors, managers, employees and agents from being prosecuted under this law.
