ESIC reduces threshold from 20 to 10 persons for applicability of the Act with effect from 1st October, 2020

The Public Health Department, Government of Maharashtra has issued a notification dated 10th September, 2020 making the provisions of the ESIC Act to Shops, Hotels, Restaurants, Road Motor Transport Establishments, Cinema (including preview theatres), Newspaper Establishments having 10 or more persons employed on any day of the preceding 12 months.

Although the Notification has been titled as "DRAFT NOTIFICATION', the Government has issued a Corrigendum Notification dated 30th September 2020 stating that the words "Draft Notification' appearing in the notification dated 10th September 2020 should be read as "Notification'

The ESIC Act has now been made applicable to smaller establishments having 10 or more persons. 

The earlier notifications had used the words "20 or more employees" and the Act applied where there were 20 or more coverable employees. . With the new amendment the Act would apply where 10 or more persons are employed
