Government of Goa amends Standing Orders to include Fixed Term employment, Notifies Self Certification Schemes for Factories & Boiler Operators   May 27, 2020

Government of Goa amends Standing Orders adopting Fixed Term Employment notified under Central Standing Orders, notifies Self Certification Schemes under Factories Act and for Boiler Operations.

The Government of Goa has issued a notification dated 8th May, 2020, published in its Gazette dated 21st May 2020 adopting the  central amendments on Industrial Employment (Standing Orders) Central (Amendment) Rules, 2018 in the state, which amends item 1 under "Schedule" of The Industrial Employment (Standing Orders) Act, 1946 which substitutes the “fixed-term employment workmen in the apparel manufacturing sector;” to "fixed-term employment". The amendment also incorporates the provision of Rule 3(A) under The Industrial Employment (Standing Orders) Central Rules, 1946 which provides that employer of an industrial establishment shall not convert the posts of the permanent workmen to fixed-term employment and that the  conditions of service of such fixed term employees such as hours of work, wages, allowances and other statutory benefits shall not be less favourable as those of the permanent workmen.

The Government of Goa has also notified a ‘Self Certification Scheme’ for Factories covered under The Factories Act, 1948 as well as for the use of Boilers in Factories. The Notification states that the objective of the Scheme is to:

(1) Reduce visits of the Inspectors for inspection of factories which opt for the scheme without compromising on safety, health and welfare of workers; 

2) Remove the requirement of maintaining various registers and submission of returns in hard format on periodical basis; and 

(3) Achieve the objective of simplifying business regulations and to bring in transparency and accountability in inspections. It also envisages objective criteria for selection of factories for inspection. (4) Provide an integrated platform for online submission of returns by an Occupier and Manager through a web based portal.
