Madhya Pradesh - Amendments to Contract Labour Act, Factories Act, Industrial Disputes Act, MP Industrial Relations Act   May 07, 2020

The Government of Madhya Pradesh has issued a notification dated 5th May, 2020 amending certain provisions of the Contract Labour (Regulation & Abolition) Act, 1970, The Factories Act, 1948 the Industrial Disputes Act, 1947, Shops & Establishments Act  & the Madhya Pradesh Industrial Relations Act.

INDUSTRIAL DISPUTES ACT

Industries registered under the Factories Act, 1948 and start production for the first time in the next 1000 days from the date of the notification will be exempted from the provisions of the Industrial Disputes Act 1947 except Chapter VA, Sections 25N, 25 O, 25 P, 25 Q & 25 R of Chapter VB. This exemption is also subject to the condition that adequate provisons are made by such industries for settlement of Industrial disputes of their workmen. 

MP INDUSTRIAL RELATIONS ACT 1960

11 industries listed in the Schedule have been exempted from the provisions of the MP Industrial Relations Act, 1960. The details of the industries have been listed in the Schedule. 

FACTORIES ACT 1948 & MADHYA PRADESH FACTORIES RULES

All factories in the State of Madhya Pradesh have been exempted from the provisions of the Factories Act, 1948 and the rules made thereunder save and except for Sections 6,7,8, Sections 21 to 41H concerning safety of workmen, Sections 59, 65, 67, 79, 88, 112, and rules made thereunder for a period of three months from the date of the notification.

Third Party certification of inspection for non-hazardous factories employing upto 50 workers. Such certification be made by Third Partiesd authorised by the Labour Commissioner will be exempted from routine inspection process. Inspection shall be carried out, with prior permission of the Labour commisisoner, only in case of seriious/fatal accidents.
Compliance certiticates shall be submitted by 31st January of each year. 


MADHYA PRADESH SHOPS & ESTABLISHMENTS ACT 1958

No Shops or Commercial Establishments shall be opened earlier than 6am and be kept open later than 12 am.


CONTRACT LABOUR (REGULATION & ABOLITION) ACT & RULES.

License granted under Rule 25 and renewed under Rule 29 will be valid for the period of the contract for which the application has been made.
