Paid Holiday to voters on 21st February, 2017 for Municipal Elections, in Greater Mumbai, Thane, Ulhasnagar, Pune, Pimpri, Chinchwad, Solapur, Nashik, Akola, Amravati & Nagpur.   Feb 13, 2017

The Government of Maharashtra has, by its above notification, announced the dates for Municipal Elections at various locations. The said notification requires all Shops, Commercial Establishments, Industrial establishments, Residential Hotels, Eating Houses, Theatres, Shopping Centres, Malls, Retailers and Information Technology companies, to grant a paid holiday on 21st February, 2017, to employees at the above Centres, who are voters to exercise their franchise at the Municipal Elections. The grant of paid holidays, however, does not apply to employees whose absence at the workplace would cause danger or substantial loss to the establishment, where there is work involving any continuous process or in the I.T. Sector, in which he is employed. Such employees should be given two hours special concession to enable them to cast their votes. Employers have been cautioned to ensure strict compliance of the said instructions. Text of the notification is attached. 
It is pertinent to note that the notification does not require that the aforesaid establishments should remain closed but only requires a paid holiday/time off to be given to employees who would be voters at the elections. 

a)  All employees, whether permanent, probationers, temporary or those appointed as Trainees/Apprentices and who are entitled to vote should be granted a paid holiday.

b) Employees whose absence would cause danger or substantial loss to the establishment should be given two hours special concession.

c) Ensure that contract labour/employees of service providers engaged for work of the establishment are also extended similar benefits.

d) Employees who are not voters will be required to attend their duties as usual if the office is kept open.

e) Employees who are entitled to vote should be requested to inform the Management accordingly to ensure that they are given the benefit of a paid holiday or time off, as the case may be.
3. The Government of Maharashtra by its Notification No.PHD. 1117/75/C.R. 23/XXIX dated 8th February, 2017, has declared the day of polling, i.e., Tuesday, 21st February, 2017, as a Public Holiday under Section 25 of the Negotiable Instruments Act, 1881. All establishments that have been following holidays declared under the Negotiable Instruments Act, will be required to observe a holiday. A copy of the referred notification is reproduced below :
